Terms & Conditions for All America Dish

These Terms & Conditions (the “Terms”) govern your use of this website and your interactions with All America Dish when we assist you in ordering Spectrum® services as an Authorized Spectrum Retailer.

All America Dish is an independent, authorized retailer for Spectrum. When you place an order through us, Spectrum becomes your service provider and handles billing, installation, and technical support. Spectrum’s own customer agreement and policies will apply to the services you receive.

1) About These Terms & Parties

These Terms are a legal agreement between you and All America Dish (“All America Dish,” “we,” “us,” or “our”). By using our website, contacting us, or requesting that we place an order with Spectrum on your behalf, you agree to these Terms. If you do not agree, do not use the Services.

These Terms do not replace Spectrum’s own customer agreements, which govern the actual Spectrum services you receive after activation.

2) Website Use & Accounts

  • Eligibility. You must be at least the age of majority in your jurisdiction and capable of entering a binding contract.
  • Accuracy of information. You agree to provide current, complete and accurate information (e.g., service address, contact details).
  • Electronic communications. You consent to receive communications from us electronically (email, SMS, chat) related to availability checks, order confirmations and scheduling. You can opt out of promotional SMS at any time by replying STOP.
  • Site availability. We may suspend or modify the site without notice for maintenance or updates.

3) Ordering Spectrum Through Us

We are an Authorized Spectrum Retailer. Our role is to explain options, verify local availability and promotions, and place your order with Spectrum. Spectrum is solely responsible for provisioning, installation, billing, performance, and ongoing support.

4) Pricing, Promotions, Taxes & Fees

  • Set by Spectrum. All pricing, promotions, fees, channel lineups, equipment charges and available speeds are determined by Spectrum and vary by location.
  • Verification. We will confirm the current Spectrum offer for your address before placing your order.
  • Taxes & surcharges. Applicable taxes, regulatory fees and surcharges are set by Spectrum and/or law and will appear on your Spectrum bill.
  • Errors. We reserve the right to correct errors or omissions (typographical or system) and to cancel orders not yet submitted to Spectrum if necessary.

5) Scheduling, Installation & Equipment

  • Scheduling. We help request installation dates; final scheduling and technician dispatch are controlled by Spectrum.
  • Equipment. Modems, adapters, set‑top boxes and other equipment are provided, owned and/or rented under Spectrum’s terms. Return obligations and fees are set by Spectrum.
  • Preparation. You are responsible for safe access for installers and for ensuring landlord/HOA approvals where required.

6) Number Porting & E911

  • Porting. If you request to port a number to Spectrum Voice®, you may need a recent bill and account PIN from your current provider. Porting timing and eligibility are subject to Spectrum and the losing carrier.
  • E911 limitations. E911 requires power and network connectivity to the voice adapter. During power or internet outages without backup power, E911 may be unavailable. Consult Spectrum for backup options.

7) Billing & Payments

After activation, billing, payment processing, late fees, and all account changes are managed by Spectrum under their customer agreement. Contact Spectrum for billing questions or disputes related to active service.

8) Cancellations, Returns & Refunds

  • Before submission. You may cancel a request with us before we submit it to Spectrum.
  • After submission/activation. Cancellations, returns, equipment fees and refunds are governed by Spectrum’s policies. We will help you contact Spectrum to process such requests.

9) Acceptable Use & Prohibited Conduct

You agree not to misuse this website or our communication channels. Prohibited conduct includes:

  • Providing false, misleading or unauthorized information;
  • Interfering with site security or attempting to access others’ data;
  • Uploading malware or engaging in scraping/spamming;
  • Infringing intellectual property or publicity/privacy rights;
  • Using our brand to imply you are Spectrum or misrepresenting affiliation.

10) Intellectual Property & Trademarks

All content on this site (text, graphics, logos) is owned by All America Dish or its licensors and protected by applicable IP laws. Spectrum®, Spectrum Internet®, Spectrum TV® and Spectrum Voice® are trademarks of Charter Communications and are used for identification. No license is granted except as necessary to use the site for personal, non‑commercial purposes.

11) Reviews, Testimonials & User Content

  • By submitting a review or testimonial, you grant us a non‑exclusive, royalty‑free, worldwide license to use it in marketing, subject to your rights to withdraw consent where applicable.
  • We may moderate submissions for accuracy, clarity and compliance with these Terms.

12) Privacy & Cookies

Our Privacy Policy explains what data we collect, how we use it, and when we share information with Spectrum to fulfill your order. You can manage cookie preferences in the Privacy Policy.

13) Third‑Party Links/Tools

Our site may include links to third‑party websites or tools (e.g., maps, chat, payments). We do not control these sites and are not responsible for their content or practices. Use at your own risk and review their terms and privacy policies.

14) Disclaimers & Limitation of Liability

  • As‑is site. The website is provided on an “as is” and “as available” basis without warranties of any kind, to the fullest extent permitted by law.
  • No service guarantee. We do not guarantee Spectrum service availability, speeds, channel lineups or pricing for your address; these are determined by Spectrum.
  • Liability cap. To the fullest extent permitted by law, All America Dish shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any amount exceeding the greater of (a) USD $100 or (b) the fees (if any) you paid to us for retailer services.

Some jurisdictions do not allow certain warranty disclaimers or limitations; in such cases, the above will apply to the maximum permitted extent.

15) Indemnification

You agree to defend, indemnify and hold harmless All America Dish and its personnel from any claims, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from your misuse of the site, violation of these Terms, or infringement of any third‑party rights.

16) Governing Law & Venue

These Terms are governed by the laws of the state where our principal office is located, without regard to conflict‑of‑laws principles. Subject to the arbitration clause below, courts of competent jurisdiction in that state shall have exclusive venue.

17) Dispute Resolution (Arbitration; Class Waiver)

To the fullest extent permitted by law, any dispute between you and All America Dish arising from these Terms or the site will be resolved by binding, individual arbitration administered by a recognized provider, rather than in court. Class actions and class arbitrations are not permitted.

  • Opt‑out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@allamericadish.online with your name, address and a clear statement that you opt out.
  • Small claims. Either party may bring qualifying claims in small claims court.
  • Injunctive relief. You agree that we may seek injunctive relief in court to protect intellectual property or site security.

18) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date will change when we post a new version. Continued use after changes means you accept the updated Terms.

19) Miscellaneous

  • Severability. If any provision is found unenforceable, the remainder stays in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent.
  • Force majeure. We are not liable for delays or failures due to events beyond our reasonable control.
  • Entire agreement. These Terms constitute the entire agreement regarding the site and retailer services, in addition to any written order confirmation we send you.
